THE Wanchai Ferry™ Sweepstakes 1) PROGRAM DESCRIPTION: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The Wanchai Ferry™ Sweepstakes (“Sweepstakes”) begins at 12:01 a.m. (ET) on July 1, 2008 and ends at 11:59 p.m. (ET) on July 31, 2008 (“Promotion Period”).
2)HOW TO ENTER: For Internet Entry: Go to the Sweepstakes web site, www.amazingchinesefood.com (“Sweepstakes Web Site”), during the Promotion Period and follow the on-screen instructions to enter the Sweepstakes. Entries must be received by 11:59 p.m. (ET) on July 31, 2008. Limit one (1) entry per person/email address via this method of entry. Multiple e-mail address accounts used for entry by a single entrant will not qualify for entry and will invalidate ALL entries submitted by that entrant for the entire Promotion Period. An entrant may receive one (1) additional entry for each valid, unique e-mail address provided at the time of entry. Each friend that you refer will receive an e-mail inviting them to participate in the Sweepstakes. Each friend must be eligible to enter the Sweepstakes. Entrant may only refer friends with whom they have an existing relationship, who the entrant believes would be interested in the Sweepstakes. Limit of five (5) referrals/additional entries per person/email address. Friend’s e-mail address must be different than entrant’s e-mail address. Comcast Spotlight, Inc., (“Sponsor”) assumes no responsibility for lost, late, misdirected entries or for any computer, online, telephone, or human error or technical malfunctions that may occur. Incomplete entries are void. E-mail addresses will only be used for purposes related to this Sweepstakes. Internet entrants in the Sweepstakes will receive future promotional materials only if they indicate they wish to receive such materials by indicating so in the space provided.
For entry by U.S. Mail: Enter by printing your full name, street address (no PO boxes) and telephone number on a 3.5”x5” piece of paper and mailing your entry in an envelope to The Wanchai Ferry™ Sweepstakes, P.O. Box 8544, Prospect Heights, IL 60070. U.S. Mail entries must be postmarked by July 31, 2008 and received by August 4, 2008.
The Sweepstakes will begin at 12:01 a.m. (E.T.) on July 1, 2008 and end at 11:59 p.m. (E.T.) on July 31, 2008 (the “Sweepstakes Period”). You may enter the Sweepstakes via U.S. Mail as often as you like, but each entry must be mailed separately. For Internet entries, only one entry per person/email address will be accepted (except for the friend referral detailed above) but you may submit additional entries via U.S. mail. Mechanically reproduced U.S. Mail entries or multiple Internet entries submitted by means of software-generated or other automated processes will be disregarded and could lead to disqualification.
3) Drawing:A random drawing will be held on or about August 5, 2008 from all eligible Sweepstakes entries received to award the prizes. The random drawing will be held under the supervision of Promotion Activators, Inc., an independent judging organization, whose decisions are final on matters relating to this Sweepstakes.
4) PRIZES/ODDS OF WINNING:ONE (1) GRAND Prize: a Six (6) Day/Five (5) Night trip for two (2) persons (winner and one guest) to Hong Kong, China. Approximate retail value (“ARV”): $3,300.00. Actual value may vary depending upon location of winner’s home and airfare fluctuations. Prize includes round trip coach air transportation for the winner and his/her guest from a major U.S. international airport nearest the winner’s home to Hong Kong, China, five (5) nights standard hotel accommodations (one room, double occupancy), ground transfers to and from Hong Kong hotel and airport, a half day Hong Kong Island Tour, a Lamma Island Evening Cruise and a one (1) day Museum Pass for two (2) to Hong Kong Museum of History. All other expenses not specifically mentioned herein as part of a prize are solely the responsibility of the prize winner, including but not limited to gratuities, meals, beverages, passport fees and ground transportation. All travel is subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation terminal (or other types of transportation) restrictions and regulations. Other restrictions may apply. Sponsor assumes no responsibility for cancelled, delayed, suspended or rescheduled events (including but not limited to airline flights beyond its control). Travel must be booked at least 45 days in advance and must be completed by July 31, 2009. Winner and their guest must have all necessary identification and/or travel documents required for travel outside the United States. Winner and his/her guest must travel together on the same itinerary. Prize winner will be notified by overnight mail and will be required to complete and return an affidavit of eligibility and liability/publicity release (where permitted by law) within seven (7) days of receipt of notification or prize may be forfeited and awarded to an alternate winner (time permitting). Winner’s guest must also complete and return a liability release and publicity release within the same seven (7) day period as a condition of accompanying winner on trip. Guest must be of the age of majority in their state of residence, unless winner is Guest’s parent or legal guardian. TWO-THOUSAND (2,000) FIRST PRIZES: a free product coupon good on purchase of any of the following Wanchai Ferry™ Dinner Kits: Kung Pao 12.8 oz., Cashew 13.4 oz., Sweet & Sour 23.3.oz. or Spicy Garlic 21.5 oz. ARV: $4.79, each. The coupons will be delivered via First Class mail and will be shipped after August 5, 2008. Limit one (1) coupon per household. Odds of winning a prize depend on the number of eligible entries received for the drawing. Total ARV of all prizes: $12,880.00. Return of any prize or prize notification as undeliverable, or failure of the winner to return required documents in a timely manner, or failure to comply with these Rules in any way, will result in forfeiture of prize and the selection of an alternate winner. Any applicable tax on a prize is the sole responsibility of the winner. No barter, transfer, substitution or assignment of prize permitted, except by Sponsor at its sole discretion in the event that the stated prize becomes unavailable. Prizes are not redeemable for cash.
5) ELIGIBILITY: This sweepstakes is open only to legal residents of the 50 United States and the District of Columbia, 18 years of age or older. Void where prohibited by law. Employees of Sponsor, General Mills, Inc. and their respective affiliates, subsidiaries, wholesalers, distributors, retailers, sales representatives, advertising, promotion and judging agencies and the immediate family members (parent, child, spouse, and sibling) and persons living in the households of each are not eligible to enter.
6)GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these Official Rules. The laws of the United States govern this Sweepstakes. All federal, state and local laws and regulations apply. Return of prize notification as undeliverable may result in disqualification and selection of an alternate winner. Acceptance of prize constitutes permission for Sponsor to use winner’s name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants agree to release and hold harmless Sponsor, General Mills, Inc. and their related companies, respective subsidiaries, affiliates, directors, officers, prize suppliers, employees and agents, including Promotion Activators, Inc., from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes or acceptance or use of any prize won or any travel in connection with such prize (“Released Parties”).
7)INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. In the event of cancellation, Sponsor will award the prize listed above in a random drawing from all eligible entries received prior to cancellation. Sponsor reserves the right to disqualify any individual who tampers with the entry process. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
8)WINNERS LIST: To receive the name of the Grand Prize winner by mail, please mail a self addressed stamped envelope (for receipt by September 30, 2008) to: The Wanchai Ferry™ Sweepstakes Winners, 1851 Elmdale, Glenview, IL 60026. Winners lists will be sent once Grand Prize winner has been verified.
9) Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, in its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
10) Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Court in Michigan (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
